Twelve (12) cumulative months of verifiable work experience as a Construction Laborer or in substantially similar
construction work. The experience must include at least three of the following: (1) construction-site clearing or
preparation; (2) loading, unloading, moving, or staging construction materials; (3) digging, trenching, backfilling, grading,
or compaction; (4) mixing, transporting, placing, or finishing concrete or mortar; (5) assisting with formwork; or (6) using
common construction hand and portable power tools. Experience is measured by employment dates, average hours per
week, and duties stated in the application or resume and may be verified through prior-employer contact, experience
letters, employment records, or other reliable documentation. Equivalent part-time experience is credited proportionately.
Essential physical functions, with or without reasonable accommodation, include standing and/or walking for up to seven
(7) hours during an eight-hour shift, with normal meal and rest breaks; occasionally bending, stooping, crouching,
kneeling, climbing, or working in low or awkward positions; frequently lifting or carrying 11 to 25 pounds; and occasionally
lifting or carrying 26 to 50 pounds, including tools, lumber, formwork components, concrete or masonry materials, debris,
and other construction materials. Loads over 50 pounds will be handled by team lift or mechanical assistance.
Manual construction duties include loading, unloading, and moving materials; site clearing and cleanup; digging,
trenching, backfilling, grading, and compacting; mixing, transporting, placing, and spreading concrete or mortar; assisting
with forms, braces, barricades, and other temporary structures; and using common hand and portable power tools. After
employer-provided training and under required supervision, duties may include assisting with erecting or dismantling
supported scaffolds. Required safety instruction, PPE, tools, and scaffold training will be provided at no cost.
The worker must be able to use a standard tape measure to read and record dimensions in feet and inches to the nearest
1/8 inch and read a simple construction work sketch, detail, or plan sheet sufficiently to identify the sheet title or number,
assigned work location, stated dimensions, material notes, and standard symbols identified by a legend. No design work,
engineering calculations, or independent interpretation of an entire drawing set is required.
The same requirements and assessment will be applied to every U.S. and CW-1 applicant. Plan-reading and measurement
will be assessed using the same representative exercise for every applicant. The applicant must correctly answer at least
four of five plan-reading questions and transfer one stated dimension with a tape measure to within 1/8 inch. Each
applicant will be asked whether the listed essential physical functions can be performed, with or without reasonable
accommodation, and the response will be documented.
The worker must be available for the regular workdays and hours stated in the ETA-9142C. Any overtime availability,

Three-Fourths Guarantee: Workers will be offered employment for a total number of work hours equal to at least

specified in the work contract or in its extensions, if any.
Transportation and Subsistence: If the worker completes 50 percent of the work contract period, the employer will provide, reimburse, or advance payment for the worker's transportation and subsistence from the place of recruitment to the place of work. Upon completion of the work contract or where the worker is dismissed earlier, the employer will provide or pay for the worker's reasonable costs of return transportation and subsistence back home or to the place the worker originally departed to work, except where the worker will not return due to subsequent employment with another employer or where the employer has appropriately reported the worker's voluntary abandonment of employment. The amount of transportation payment or reimbursement will be equal to the most economical and reasonable common carrier for the distances involved.
